They have to be careful, they truly don't want him to serve time, they want to drag his name in the mud and zap his energy and money.
If they convict a former president of having documents (like every other president in history ..and others...who have not been even indicted)..then that precedent can be used against them later.
They have to look like Trump "got off easy" based on unfair R help, ie a judge he appointed, etc. That way, they feel, they win all around. Trump got indicted, convicted in the media, distracted from campaigning, then they can play victim when he's set free.
