So how does Brandon appoint a black female to SCOTUS?

How does Biden appoint a black female to SCOTUS now that he has broken federal discrimination hiring practices? I've seen the comments by Professor Turley and Alan Dershewitz. Biden stating that he would only consider black females for the SCOTUS job is a clear violation of federal hiring practices.
How does Brandon hire black female to the court without breaking the law?
I know the law doesn't really matter to Brandon but just wondering how he gets from under this unnecessary conundrum he has created for himself. He probably doesn't even care.

He would have been much smarter to say he was gonna appoint the best and then appoint a black woman of his choosing......but what do you expect, he is a walking gaffe machine. Also Biden is a known racist unless he's had a total change of heart from his time in Congress.....

There will be zero official that will stand up and call this racist and illegal.
The only hope is an Hispanic or Asian to bring it up.
Whites are not allowed to do so, since there are too many white pansy liberals that will call you racist for calling Biden racist.

This administration has multiple times said what they’re doing is likely illegal, but said they’re going to do it anyway until the Supreme Court strikes it down. This administration doesn’t give a frick about the law, and Merrick Garland is the biggest thug we’ve ever had as AG. To think I breathed a sigh of relief when Biden picked him instead of Eric Holder, but I’m sure Holder would be every bit as vicious this time around as Garland was this time.

Brandon's people really don't care about the law. I think what they are concerned about is the most recent poll showing that 73% of the people believe a SCOTUS judge should be appointed on the merits and not appointed based on immutable characteristics. It's clear that Biden wants to appoint a judge based on immutable characteristics.
Breaking the law is not his problem. No one will hold him accountable. Breaking the law, then making news that impacts his poll numbers more negatively appears to be the administrations main concern.

The size of the bullet dodged when Garland's appointment was held by the Senate cannot be overstated. Trading Scalia for Garland would have been disastrous, with the Constitution becoming nothing but a footnote in history.

Biden trying to grandstand and pander is making his nominee appear to be a diversity hire. All he had to do was conduct a search and announce a black woman as best qualified but his admin is too stupid to even do that.
