Dominion will have to show which statements Rudy made were false, and prove that.

Rudy can certainly defend himself by proving his statements true, but the burden is Dominion's. Not Rudy's.

So, maybe a statement made by Rudy is inconclusive. If Dominion cannot show it false, Rudy is not liable.

In order to establish his defense, I suppose the court will have to allow Rudy to crack open the machines in the footprint, as Wednesday called it.

Didn't the media outlets sued by Wood in the Sandman case pretty much say the same thing about the amount asked for with regard to freedom of the press/speech. But hey its the media so frick'em right.

He will certainly be able to engage in discovery. Analyzing machines by experts could very well be a part of that process.
