Only hospitals? What about ltac, rehab, nursing homes?

Also someone said it’d really only federally funded places like VA and states rule on their own.

They will not risk pissing off their voters with a mandate. They do that and the left quickly loses a ton of power.

I’m not positive but I would assume any facility doing Medicare/Medicaid work.

There is a HUGE difference from a private employer requiring someone to get a vaccine vs. the Government FORCING a company to require it. This was still a HUGE loss in my opinion.

For the healthcare workers, Roberts and Kavanaugh's ruling isn't about whether they believe there should be a mandate...but whether the government has the power to enforce it.

Basically they ruled that vaccine enforcement does not fall under the authority given to OSHA, but the healthcare mandate is within the scope of power given to DHHS.

I am not surprised by the split and somewhat surprised it was 5-4 not 6-3 on the Healthcare workers suit.

Would I have liked to see the HCW one get struck down as well, yes. But the case is completely different than the OSC one...

Maybe. Both the OSHA and CMS rules will continue to be litigated at the circuit level.

Only the stays were at issue today.

Court feels that ultimately the plantiffs will prevail in the OSHA case based on the merits so they placed a stay.

And they think the government is more likely to prevail in the CMS case so that can move forward while the case is heard.

But neither case was actually decided today.
