I guess we need to get used to adding Kavanagh to the line we've heard thousands of times "John Roberts sides with the courts liberals".

Because of precedent. Hospitals have long mandated flu shots, hepatitis vaccines, etc for its workers.

As I understand, the healthcare worker mandate is only for medical facilities that accept medicare/medicaid (i.e. federal funding). They upheld that mandate since in their opinion, the fed should be able to dictate certain rules in order to receive federal funds.

OSHA was just a broad, general brush stroke of a mandate applying across every sector no matter if they received fed funds or not.

you take the government cheese, you live by the government's rules.

think of the applications to EBT, public housing, medicaid, SSI, etc.

I don’t see how anyone can uphold any mandate now that the cat’s out of the bag about the ineffectiveness of the shots (and potential harm).

By who?

As I understand it, and I have not been following closely, the healthcare worker mandate was approved because hospitals and such are paid by the government.

Much like a contractor can require subs to meet insurance limits, diversity agendas, etc. If you are working for the man you have to follow the man's rules.

Healthcare businesses have a much different precedent and set of rules than general businesses for a multitude of reasons in this case the most important ones seem to be the amount of government money and regulations they freely take on and the specific type of work they do

It was also stronger legally than the OSHA one simply because it was more targeted. It only applies to the hospitals dealing with Medicare and Medicaid. That connection always made it more likely to stick than OSHA’s, which is a blatant overreach.
