That means that your local office might follow the rules, whereas mine didn't.
And after I posted that I remembered more cases in which we were successful in causing denials of some claims that were made without proper cause, but the fact that any of the cases we had would fail is ridiculous. Every one of them was documented properly and furnished to the agency.

I also have a hard time imagining any well run company having to rehire the same folks immediately post layoff cause they can't figure out someone is promoted....that's a whole new level of being a shitshow.

Can you imagine a CEO giving an interview bragging about how his layoff tactics are more than likely unconstitutional, but the beauty of the situation is that by the time the Supreme Court rules on it the purpose of the layoffs will have been served?
