Against the male and not the female?

Set aside “blackout” situations. Just 2 drunks voluntarily copulating.

Both are non compos mentis. Each is playing with the naughty bits of the other. Why should one be a perpetrator and the other a victim, in the eyes of the criminal law?

Because the legal system is biased against males.

Women are powerful and independent. Except when it's convenient, then they have no agency and are treated as though they are minors.

Seems like an ironclad defense.

Pretty sure it has something to do with men needing to be aroused and women just being present. How are you going to prove that she forcibly gave you an erection and penetrated herself on it?

It's ultimately your word against hers, and if she's got "evidence" then you're going down.

I don't believe the law says that the man is automatically at fault does it? But wouldn't it typically be the person who initiates that would be at fault? That is usually the man.

The girl was a sophomore, and the guy was a senior. I was a junior. They were fricking like rabbits, and her parents filed charges. (This was long before Texas enacted its Romeo/Juliet statute).

The girl was from one of the “old families,“ and the boy was recent oil field trash. Her father had known my father since birth, so my father asked me what was really going on. I told him in no uncertain terms that she was fricking that boy for free weed, and that no one was forcing anyone into anything. Dad told his friend, but the family pressed the matter anyway. Small town politics.

The kid was convicted.
