Citation requested. SCOTUS has never applied the speech restrictions for *active duty* military members to retired military members. You may want to read Judge Leon’s opinion.
Citation of scotus ruling supporting your claim? You have already admitted he is still subject to the UCMJ. Which provisions of the UCMJ has the Supreme Court ruled don’t apply to retired service members still receiving pay?

The inference was clear. You know that.

Good order and discipline is the reference.

Is an officer permitted to use an unlawful order to ensure good order and discipline?

In normal circumstances, no.
This is a circus built on revenge and social media clout, so you can't compare it to a normal prosecution.
Yep, RussiaGate never happened or anything. The intel community didn't get together to bury the Hunter Biden Laptop story. Everything is above board besides OMB.

Has no relevance to my comment. Also may not be a crime at all.

What actually happened was not even a crime

And arresting/charging someone likely isnt a crime either.

From this:

What a weird digression you're attempting

Youre the one that brought up whether something is criminal. You literally did it in the last minute. Have you already forgotten?

quote:Intimating that soldiers are being, or have been, subject to illegal orders, and that their participation puts them in legal jeopardy, absolutely interferes with order and discipline. The assumption in our military, by law, is that orders are lawful and are to be followed. The ONLY instances of conferred liability in following orders would be those which are unquestionably egregious. Kelly intentionally injected question into that equation.
Telling soldiers they don't have to follow illegal orders does not interfere with any lawful order

any arrests yet?
SFP posted a hypothetical if arrests would have occurred. I'm responding to that hypothetical.

That was the beginning of your digression, which should have been shut down when I pointed out how bad it was. Then you doubled down.

i wasn't responding to your post directly, yours just happened to be the last one

This existed without the language. They're always subject to these standards and these decisions.
That's why trying to pivot here doesn't work, no matter how much you try.

Kelly's words state the accurate status of the law and UCMJ.
You can try to spin them in a partisan way and fall into his trap, creating a Streisand Effect and a ton of Ls, or be smart about it.

Perfect example of you being a partisan hack.
Thanks for playing.

What?
Nothing I said was partisan in anyway, unless you're defining partisanship as people who understand what are actual crimes and those who don't.

When the Trump admin is threatening arrests, its revenge and social media maneuvering.
When Dems lie to the American people and manufacture foreign interference in our elections its "DuR tHeY dIDn'T cOmMiT aNy CrImEs ThOuGh".
Then, when I also point out that making arrests and charging people for crimes is likewise likely not a crime, you knock over the checkers board.

So you don’t have a citation? Got it. Thanks for clearing that up.
