Post judgment, plaintiff gets assignment of rights from defendant and sues both the insurer and the law firm. The law firm. This is not a failure to settle case, as there was never a chance to settle the case against the driver.

This is why Rule 11 exists (it will be removable to federal court).

Is Fani proving this to be true or false?

As a lawyer, the answer is f*** no lawyers are not smarter than the general public. There are smart ones and dumb ones. Lawyers are technicians just like a doctor or plumber. We have a way of thinking that we are trained on, just like other technicians. It doesnt make us smarter.

People think lawyers are smarter because on TV you have the Supreme Court, Grisham novels, etc... showing the smart lawyers. You dont see the mouth breathers doing traffic tickets and such because it's not tv-worthy.

I've been reading about her for weeks but never heard her speak until this morning. I heard about 5 minutes of her talking in court. By her speech style and vocabulary I would have guessed she might have a H.S. diploma or maybe a GED.

I assume there will be diversity so that the case will be removable under 28 usc 1332 (if the judgment is that big, they won't stipulate). I would submit the claim against the law firm is a fraudulent jointer for the purposes of defeating diversity. Once there, assuming the facts are as you say, this would be a completely baseless suit with no good faith grounds. Should be sanctionable in Louisiana, but judges (elected) never do that. Federal judges will drop a hammer.

That doesn't make them enough to drag down the IQ of all lawyers in total

Lawyers are in fact a higher IQ profession in aggregate when compared to the general population

Everyone should know that

agreed--law school is training, not education. I think that it's only fair that those who universally condemn lawyers should note their occupation. I'm proud of the way i practice law and apologize to no one.

Given that malpractice is purely personal and not assignable, I think you are correct.

Yes, she's one of the few exceptions that give me hope.

I think we need more Conservative women to become Lawyers

There are plenty---but you won't see them on TV or in some lawyer-activist role.

And the phrase goes “the cream rises to the top.”

If a high profile lawyer is this incompetent, that doesn’t say a lot about the ones we aren’t seeing.

She didn't get the job because she was a good lawyer---she got elected because she was a black woman.

It would be like saying "well district judges in Louisiana's major cities are almost universally incompetent, so all the lawyers we don't see must be dumber than that." Which isn't true.

Its just a symptom of an elected judiciary. Legal merit plays no part in how these people get their jobs.

Haven't seen much of Lightning since soon after the fraudulent 2020 election.

I'm hoping she's doing well, and hoping maybe she went dark on tPT because she took a major job representing conservative causes.

Those two ladies are among the most intelligent and educated posters on this site.
