soo on a parallel path, should the authorities be held civil liability for discharging a dangerous mentally not competent person? Causation/corollation should not be a problem. its far more obvious than round-up or plastic nurdels

It is not "just" a delay, it is a way to syhon off money. Lawyers will be paid among others.

Legal fees are why our "justice" system exists.

It's not about that. He isn't pleading not guilty by reason of insanity because he has been found incompetent to do so. He may plea that later if he becomes competent to stand trial. Even then, the law defines insanity as not knowing right from wrong at the time of the commission of the act. His diagnosis is otherwise irrelevant in the eyes of the law.

Anyone with such a severe mental illness who commits such a heinous crime should be put to death. There is no chance of reforming them and they are too much of a danger to themselves, the community and even other inmates to provide them with a home, food and medical care for the rest of their natural life.

Actually, an affirmative defense generally shifts the burden of proof to the defendant.
