soo on a parallel path, should the authorities be held civil liability for discharging a dangerous mentally not competent person? Causation/corollation should not be a problem. its far more obvious than round-up or plastic nurdels

Pin a note on his chest indicating he wishes to be euthanized and send him to Ottawa.

So he wasn’t insane the last dozen times he was violent?

There's ZERO reason he's still alive. NONE AT ALL.
The legal racket making money by dragging this kind of crap out is about the only reason I can see.

It's just a delay, 6 months to a year. Even if the judge (not just a psychiatrist) agrees he is incompetent he will be treated for his schizophrenia and face charges once he is found competent enough
It is not "just" a delay, it is a way to syhon off money. Lawyers will be paid among others.
Legal fees are why our "justice" system exists.

Apparently, he was alert enough and understood his surroundings well enough to say on surveillance video: "I got that white girl."
But that is the ramblings of a madman in 2026 who is not responsible for shite (according to Dems).

He goes to a state psychiatric hospital until he becomes competent or dies.

Those public defenders...raking in the dough from hourly billing.

In the court motion filed Tuesday, Brown’s attorney claimed that the court required capacity hearing cannot take place as long as Brown remains in federal custody. The attorney also argued that the court can’t order to restore Brown’s capacity while he’s in federal custody. According to the court filing, the Mecklenburg County District Attorney’s Office agreed with the case being continued. Brown has also been ordered to undergo a pyschiatric examination as part of his federal court case. However, court filings from March 6 indicate the examination isn’t completed and the evaluation period has been extended. Several attorneys noted it is extremely rare for a defendant to go through the mental health evaluation and competency process at state and federal court at the same time.

Correct me if I'm wrong, but isn't the burden basically just that the defendant understands who the members of the court are and what's he's on trial for/assist his lawyer?
And that he understands the potential sentencing outcomes should he be found guilty.

because THAT is what they are going to do for their entire life
No public defender has ever used the experience to get a high paying lawyer job ever.
Don't be stupid.

It's not about that. He isn't pleading not guilty by reason of insanity because he has been found incompetent to do so. He may plea that later if he becomes competent to stand trial. Even then, the law defines insanity as not knowing right from wrong at the time of the commission of the act. His diagnosis is otherwise irrelevant in the eyes of the law.

Anyone with such a severe mental illness who commits such a heinous crime should be put to death. There is no chance of reforming them and they are too much of a danger to themselves, the community and even other inmates to provide them with a home, food and medical care for the rest of their natural life.

The problem with our justice system (at least in most states and at the federal level) is someone only has to simply claim insanity.
The burden then shifts to State to prove, beyond a reasonable doubt, that the person is mentally competent.
Actually, an affirmative defense generally shifts the burden of proof to the defendant.

That's the state case.
I suppose the federal court can say he's competent and he can move forward there.

hang that POS now and do not waste another dime of tax payer money.
