As James Madison observed in the Federalist No. 44: The prohibition with respect to titles of nobility is copied from the articles of Confederation and needs no comment.
Anyone who thinks that grifter would ever (a) relinquish her Duchess title, and/or (b) cut a check to the US government (i.e., to address the emolument clause of the Constitution) hasn’t followed her behavior(s). No way in hell is this chick giving up money and/or a title.
The term emolument was strategically chosen by the Founding Fathers (weren’t they brilliant?) to include any kind of payment or fees for services. It’s very broad and can even include gifts. Any money falling her (Markle) way from Harry renders her ineligible to hold office.
And if someone wants to hypothetically argue she could simply cut a check for the nobility part of her income … it would take a team of highly qualified forensic accountants to tease out what portion of the money in her pocket—to include clothing, the income she derives from using the title Duchess of Sussex, the diamonds in her engagement ring (the list is long)—comes directly or indirectly from the estates of the British Royal Family.
Markle’s worth will soon include cash payments from nobility for divorce, child support, etc.
There’s no way this (Sen. Markle) would ever happen. The people of California are at greater risk of Oprah winning the seat than they are of Meghan Markle doing so.
