Wrong.
BTW, this sounds a lot like the case where the older dude ambushed the "burglars" in his basement.

They beat him. They repeatedly robbed him. Had they never bothered him, she would be alive.
Good riddance. Live your own life and leave others the frick alone and this doesn't happen.
Consequences. They should have considered them.
If she was pregnant, this guy probably saved the state of CA a shite ton of money.
As far as legal defense? Multiple blows to head. Any neurologist gets this guy off.

Is California the only state where it is illegal to use deadly force against a fleeing criminal outside the home? I thought that was universal.

This. If it was a pattern and escalating, he had ever reason to fear for his life. Especially after pulling a gun. They'd most certainly beat him to death the next go around.
Could he have instead waited a week or so, then gone to their homes and killed them in their sleep?

He shot her once and she dropped to the ground, then walked up to her, heard her beg for her life claiming to be pregnant, and finished her off.
Huh? Where does it say that he shot her again on the ground for a kill shot? The article says he shot her twice in the back while she ran and she collapsed in the alley where she died.

Am I supposed to feel bad for this chick?

I am friends with a codgerly old bastard who happens to own a supply house in a nearby town. I will call him Mr. H to conceal his identity.
Many years ago, Mr. H's store was burglarized several times. He was able to determine that they were breaking in by unscrewing a sheet of tin from the wall just enough to pry it back and squeeze through. This gave Mr. H an idea.
He hung a dozen strands of monofilament line about six inches inside the building next to the seam in the tin wall they were squeezing through and tied several treble hooks on each. He knew they were having to stoop down and come through the wall forcefully without being able to really see where they were going.
It took a while but it worked like a charm. He opened his store one Monday morning and found a little blood smeared on the tin which was still pried back, two of his lines were popped and one of the hooks had a small piece of hairy skin on it.
He thought about it a while and decided the thought of the MF'r that was robbing him dancing around in the dark with treble hooks stuck in him was way more satisfying than just shooting the SOB.

Anyone who steals from someone is a worthless POS. I cant understand the mentality of anyone who tries to sympathize with the criminal in any circumstance. These POS’s take not only the material goods that honest people work for but they also take away their peace of security in their own homes. This theft last longer than any material loss. These POS’s don’t contribute a damn thing to society and are a complete waste of life. They are too lazy to work for what they want. They instead, prey on the lives of honest people. They are predatory animals. They have no morals whatsoever and should not be sympathized with ever. What most people seem to skip over in their opinions of these type of situations is WTH gives these animals the right to break into someone’s home, take things that don’t belong to them, and endanger the lives of those who live there. This type of behavior goes against every sense of what a civilized society is supposed to be. Therefore if a person decides to go against societies norms, he should not be protected by those same norms and should be treated as the rabid animal he is acting like.
How many times do we see where these animals have rap sheets a mile long. WTH is wrong with our legal system that sees repeat offenders released back into society only to commit more crimes. Also you never hear or see where the victim is ever compensated for their losses either to themselves or for their stolen assets. The system of justice should be designed to repair the victims instead of just incarceration of the perpetrator. The perpetrator should make restitution to his victims through forced labor administered through the state in work programs. If they injure a victim, they need to work off the cost of the medical expenses. If they murder someone, they need to work to help support the family that was left behind.
Criminals are a burden on society their whole lives. First they prey on society for their own selfish needs and then society has to pay for their existence in jail. I say that if these animals choose this coarse in life then get some use out of them by making them work and pay for the damages they did to society.

Using just the article, there is nothing mentioned about him wounding her and then later kiling her. Simply says (as mentioned in a previous post) that he shot her in the back as she was fleeing. Quite frankly, considering this was a home invasion with an aggravated assault, I believe it was justified (pending the release of addtional facts).

A lot of folk do their moral 'analysis' from the comfort of a chair...imagining the scenario. Minus the adrenaline, outrage, fear and hormonal impact. I doubt most have ever even been in a hand to hand competition and felt the effects; must less having been criminally assaulted by heartless sociopaths. Once you get pumped...it all changes. I'd probably have cut her head off and stuck in on a pole in my front yard...before coming back to reality.
And a broken collar bone in an old person ain't easy. It is substantial. He had a lot of painful time to contemplate the NEXT atrocity.
Like an old WWII friend told me (in regard to a personal crime)..."this would not have happened fifty years ago, because there would have been blood". Whatever we tolerate...we get more of. Period. Tolerance and mercy should be qualified.

I never thought to take into account his injury or his adrenaline. Pretty good weapons handling/marksmanship.
And on a separate note, her pregnancy did not seem to interfere with the aggravated assault on him.
Sorry, play stupid games, win stupid prizes.

Why would a pregnant woman commit burglary?
To pay or her future child's college education.
Seriously, I'll go out on a limb and say she wasn't really pregnant but just said that hoping it would make the old man think twice about shooting her.
It didn't work.

She was pro-choice. She chose to break in to an old man's house and beat him up instead of being content to live off of taxpayers or (gasp) work for a living. Choices have consequences.

Im mixed on the first shot... However, if I'm reading it right and he walked over to her lying on the ground and finished her off while she was begging for her life, its murder and he deserves prison.

If this consequence for committing burglary becomes the norm with no one pissing and moaning for the criminal's well being (which is just laughable since they have no respect or concern for the victim) then we would see a drop in burglary for sure.
If this story hit the news and was "BURGLARS BRUTALLY BEAT AN OLD MAN" everyone would be wanting them to hang. Now the old man is being criticized for his actions, seems to me he helped society by ridding it of a burglar.

I was correct.

An autopsy later found that Andrea Miller, 28, was not pregnant, said coroner's spokesman Ed Winter.

Can you quote that part or link it? I read this as he shot her 2 times in the back. She then fell in the alley where she died.
