Legal or not, I feel like they put themselves in a position where fighting to the death becomes possible. They essentially started a fight this guy was willing to finish. As far as being pregnant, I'm not going to stop and perform an ultrasound. These people were only sorry and started begging because the tables were turned on them and they were no longer in power.

As someone mentioned before about the Minnesota man Bryon Smith.

Do you think he's guilty of murder? A jury convicted him of murder.

It's damn hard to listen to the audio of him as he kills them.

This is a good point. Especially if this is a red part of California--the jury will be looking for an excuse to let the beating victim off the hook and that, even if you think he crossed the line, is enough for reasonable doubt.

I didn't see that, but I agree that would be murder--it would be a premeditated execution rather than finishing a fight the "victim" started.

Heard on a talk show last night that her partner in crime could likely be charged with murder because he was involved in a crime where a murder took place.

Just wondering how both the crook and the old man would be charged with the same crime.

Just the way the law's written. Technically, it's very possible that this was a justifiable homicide and not a murder. But the accomplice committed a felony that directly resulted in a death, so that makes him guilty of murder.

Felony murder is a common concept--you don't have to be the actual triggerman to be charged. Everyone involved in the crime is guilty.

How was this self defense ?

They where fleeing the house. Even though they robbed and hurt him they where fleeing the scene.

That clearly isn't self defense. Should he be charged I don't know because he was the victim. But charges won't be dropped on self defense alone.

Two people have posted that but neither responded when I asked where they got that information. I think it's not true.

They should give the old man a reward and build a statue for promoting a safe neighborhood. How many times does a person have to be abused before justice is done.
I thought it was three strikes and you're out. It appears the old man believes in that rule if the justice system doesn't
