What a lot of you people don't realize is that the "full amount of the charges" is a made up, fraudulent number. Medical providers are in bed with the plaintiff lawyers and know to charge the biggest number possible in order to maximize the plaintiff's recovery and keep the repeat business flowing. The doctors know that the amount of the charges is something that will never, ever get paid by anybody -- except possibly the unlucky tort defendant and his liability insurer.
Some lawyers finance the medical expenses with a loanshark known as a "litigation finance company," which cuts a deal with the doctor up front for a reduced payment (such as where the doctor accepts $25,000 for a back surgery for which "bills" are generated for over $100,000). It happens every day. I see it every single day of my life.
These plaintiffs aren't disinterested victims in this game. They are getting windfalls that are collectively engineered by the plaintiff lawyers, the doctors, and the courts.

The market on insurance is set. It’s not coming down.
Insurance companies don’t give a shite about Louisiana. They could completely pull out and go on in the other 49 states business as usual. We are too high risk for property without the high dollar infrastructure. Auto they scalp everyone because they can.

The defense attorneys love the fact that plaintiff attorney’s run amock through our legal system making unreasonable demands. It makes them money.
Consider that plaintiff attorneys don’t get paid until the case settles so why does it take soooo long to settle a case?
Well because defense attorneys have financial incentive to strong cases out.
Plaintiff attorney’s make unreasonable demands and defense attorney’s who are “fighting to defend the insurance company” from these unreasonable demands, file all sorts of motions, do depositions, investigations, mock trials and untold emails and phone calls with the insurance carrier to discuss strategy and whoknowswhatelse all in the spirit of beating the plaintiff attorney.
What they’re really doing is chalking up hours since they get paid by the hour.
Consider that 95%’of cases settle out of court and you see that the system is kind of rigged. They settle because the courts are overwhelmed and push cases to settle out of court. Defense attorneys know this but act like they’ll end up in court. They won’t.

The liability carrier doesn't "reap the benefit," every other premium payer reaps the benefit. And anyway the " buh buh buh muh health insurances!" argument is so much bullshite now anyway since the ACA made it illegal for all US citizens to NOT have health insurance.
