Kavanaugh sides with the class action trial lawyer protectors on SCOTUS

Litigation is out of control.

Now Kavanaugh is saying that consumers can advance an anti trust class action lawsuit against Apple.

The conservatives were against it and the liberals including Kavanuagh and RBG were for it.

I’m disappointed in the conservatives in this case. Kavanaugh is in the right. Monopolies should not be protected

I like the decision. Sets up the future vs tech that are monopolies.

He's a constitutionalist. Every supreme court justice should be like Kavanaugh, he puts the constitution before his own opinion and is easily the best justice we have.

FB/Twitter better watch out. Apple was trying to use the "we are just the platform" argument.

Apple does have merit here when one considers the need of security for their products. They have costs to vett more than andriod does. They have also have said they are looking at making things easier for app developers, so will help make prices cheaper.

Or the customer can use different options like andriod. The OS is a pure platform. Hope the judge that heard this understands technology devolpment way better than scotus, and the folks roaming the Halls of DC.

Seems like it should be a 9-0 decision.

You shouldn't have to jail break your iPhone to install an app Apple doesn't like. Just let people install it and give them a warning before hand that by installing this app you will break the terms of service with Apple.

I hope this decision leads to "unapproved" apps being readily available for install on iPhone. The Apple app store is one of the main reasons competitors to Twitter and FB have trouble getting off the ground. For example if apple allowed GAB app to be installed on iPhone the competition toward Twitter would be much bigger.

he made the right call. digital ecosystems for devices are new territory and the rules need to change regarding them.

People against this ruling don't realize this is the exact same thing as letting car manufacturers have exclusive rights to the parts and repairs on their products, while letting them be the only source to get both. It is anti capitalism. Could you imagine having to only deal with the ridiculous prices of dealerships when repairs or parts are needed? That is this. Now people can sue and let courts decide on what the rules will be.

How so??? Apple does not set the prices the developers charge for apps.

They merely offer a store for developers to market their goods not unlike WalMart stocking merchandise.

The trial lawyers wanted the deep pockets of Apple and not the rinky dinky pockets of some kid that invented a new IOS app.

What monopoly is there?? None I see.

The simple solution for Apple is just to close the store and only offer free apps they develop.

Is there a point to this OP?

I mean, I don't agree with KAV here(albeit it's a kneejerk reaction on my part in need of more info).

But still. I don't expect justices to agree with me 100% of the time. I guess it would be cool if they did, but even people who think largely the same as me will disagree on occasion

Perhaps, but that needs to be dealt with in Congress.

I don't know if I support the people suing Apple, but I support their ability to sue Apple, based on today's laws.

Some of you will melt due to Kavanaugh "siding" with the left, but a good justice should never be political, he should judge each case on the merits.

Does Apple charge my CC, or does the app developer?

Does Apple even ALLOW developers to sell directly to the customer?

No, the simple solution is for Apple to allow customers to use the phone any way they wish. If the customer downloads something that breaks the phone, that's on the customer.

No different than a computer.

I mostly agree with you, but at the end of the day you have an option to do just what you want. You could move to that option. Why get an Apple product if you don't want the security it has in place?

Other apps can make strides on Andriod, and put in the effort to do it on Apple if it's worth it. Options are there, and have been known. Apple isn't doing it to stifle freedoms, but to try to offer a true platform option that preserves them.

Exactly. The underlying issues are irrelevant. You should be able to sue anyone you want. Why should Apple get protection?

Now...whether the suit is remotely successful is a whole other issue.
