What standing do they have if Apple is not receiving all the money for the app???

They are simply operating a store of apps that can be used with their IP--IOS.

How are they limiting APPs or creating a monopoly? There are thousands of apps on the Apple store. Many of the apps compete with Apple's own resident apps on the IOS like calendar and mail.

The solution seems to me for apple to revise their operating system to accommodate unapproved apps but make the user agree to new terms using the unapproved apps.

I'm a little aggravated that Apple doesn't carry the GAB app. There is no reason for them to exclude GAB. They just do it to cock block Twitter competition.

I mean. I'm guessing the argument against Apple is that Apple tightly controls who can sell on their appstore and that there are no 3rd parties who can sell apps to use on Apple products without Apple permission.

Will that meet the standard once this thing goes to court? Dunno.

Yes but they pay the developer keeping only a fee for processing and store profits.

They don't limit access or create a monopoly.

Why? You buy the phone knowing the apps you want will have to work with IOS just like when you buy a android. IOS apps will not work on those phones.

That sounds like a bunch of issues that need to considered AT TRIAL.

I'm not ready, nor do I have the tech understanding, to say if Apple should be held liable here.

At trial, Apple will have plenty of chances to say why they should not be held liable. But to say that they shouldn't even have to defend themselves in court, no, I'm not willing to go that far. Too many unknowns.

Well, actually, Kavanaugh isn't much of a scholar. What we will all see over time is that his mental weakness will make for some strange and possibly disruptive opinions.

That's always been my knock on Kavanaugh. He doesn't have the intellectual horsepower to sit on the Supreme Court.

He expanded the use of the Sherman Anti Trust Act allowing it to be applied to third parties.

If you buy a non Apple mail app on the apple store who is liable for it's performance? Not Apple. The transaction responsibility is with the developer.

How could they possibly be punishing a consumer with monopolistic practices by simply operating a store with the goods of thousands of developers?

The trial lawyers wanted the deep pockets of Apple and not the rinky dinky pockets of some kid that invented a new IOS app. 

What monopoly is there?? None I see. 

The simple solution for Apple is just to close the store and only offer free apps they develop. 




Dude, all this ruling was is that apple can be sued, who wins is up for debate and I think apple will. However, anybody should be able to be sued, apple shouldnt be exempted from that.

No he didn't.

You seem to think that this case has already been decided.

All he, and 4 other justices did, is say, hey, let's let the case proceed and see where it goes.
