My only guess is this judge is trying to make sure keeps getting invited to all the "cool" democrat cocktail parties. Literally none of this makes any sense.

Sullivan can do this but he’s just playing political games here, potentially, if he digs in and refuses to grant motion to dismiss.
He has two moves here:
Grant motion to dismiss; at that point it’s over.
Or
Refuse to grant motion to dismiss; at that point I would be absolutely floored if he wasn’t overruled on appeal. It would be a stunning exercise of deep state power commitment to uphold such a ruling.

The judge doesn't have to grant the Motion to Dismiss the Charges against Flynn
A judge cannot Sua Sponte prosecute someone. Or revive a prosecution that the prosecutor dropped.
It’s not a stupid decision. It’s a decision he doesn’t have the power to make.
You fricking Democrats and complaining about fundamental norms bc trump calls Schiff pencil neck. That’s not a fundamental norm. Permitting a legal version of a lynch mob to decide whether someone should be sentenced basically hasn’t been cool since Barabas.

but capacity and mens rea are foundational elements of the criminal justice system so how do you ensure both are met during a plea?
What exactly are you arguing here?
If you’re saying things that are patently false in practice are bedrock to an institution , the institution has no bedrock.
It’s not hard.

Don’t need to. If you care to address my point go ahead. If you don’t, dont.

The only thing this episode demonstrates to me is that the USA itself has about 100 years left to its existence.
This nation-state is terminally ill with an incurable disease.

Technically true, but if the govt is dropping the charges against Flynn, who is left to prosecute?
This motherfricking POS judge is just the sort to appoint a special prosecutor.
I am seething right now.
The thing preventing me from expressing my true thoughts is I don't want to be banned, disbarred or arrested.

One other thing, are defendants sworn in for pleads in federal court?
You are entering arguments not testifying to fact.

100 years is on the high end IMHO.
If the election gets stolen in November, shite will get real, quick. Especially since we know what Slow Joe and company are capable of.
