The President determines what the mission is for DOE and what level staffing they need. Not some hack judge.
What we need to be doing is figuring out how to hold some of these hacks responsible when the idiots they turn loose do what the moron in Kentucky did.,

Any obligations can be fulfilled by other agencies in the federal government. The Dept. of Education is not necessarily needed to fulfill that role.
