They don't care. It's the same as the eviction moratorium Biden just reenacted even though he knew it wouldn't pass legal muster. He is going to do this and hope businesses pick it up before the Supreme Court has a chance to shut it down.

Simple. Start requiring it via an executive order. All of the big companies are already in league with them on this, so they will mandate it, and they will require it of their supply chain companies. We, the supply chain companies, will see no profit in challenging this in court, because we will lose our big customers.
So some companies, whose clients are people rather than Microsoft, Amazon, Exxon, etc, will get away with defying it, and the Feds will probably not challenge them for fear of losing in court, but most of us will have to knuckle under to stay in business.

Doesn't the mandate say vax OR test? The latter seems way less bad.
