K. Ima need one of the lawyer baws to explain how 7th circuit enjoind a fl state court. The 11th i would buy but illinois?

Illinois?

I get that they are hq there. What i dont understand in how that allows the 7th circuit to impede on fl state laws being violated. If I broke a law in fl I dont get to fight it in a different state

Honestly, cannot believe it made it through the fed circuit court up to the 7th and they agreed regarding the frivilous and bad faith nature of the claims in Florida state court.

In reading the RICO and FDUPTA allegations, it just seems that a law in Florida making it a crime to recommend any gender affirming care would have nipped it in the bud as any pediatrician making the recommendation would be charged.

The 7th Circuit is considered slightly liberal. I might argue otherwise as more liberal.

Now it appears there will be a hearing on the injunction and a trial up there. Not sure Florida wants that.

Presuming SCOTUS affirms the exercise of jurisdiction.

Pro tip, federal courts tend to be very conservative when it comes to the exercise of jurisdiction, especially where there is a colorable basis for state jurisdicrion.

All Florida has to do to stop this is have the legislature establish a civil cause of action making this medical malpractice and the plaintiff’s bar will do the rest.

The 7th Circuit ruling will be overturned.

But frankly, that is not enough. Justices responsible for the idiotic ruling should get an absolute stomping from SCOTUS

I am leaving for work in 5 minutes, but extremely briefly, I imagine they used Younger v Harris, which has a bad-faith carve out. This basically says a federal ct can enjoin a state court in a criminal or quasi-criminal action that appears to be brought for the purpose of harrassment/no clear chance of success or a pattern of abuse. In these cases, it allows the fed ct an exception to provide equitable relief.

I will try to swing back during the day or this evening if questions come up.

Going to SCOTUS on a temporary injunction when they are going on vacation until October ....

The full hearing on the temporary injunction can take place next month and then up to the 7th if granted and probably make it to SCOTUS by December

A Fed Ct can enjoin any state court if it has in personam jurisdiction over the parties. The 7th Cir would have ruled that the Federal District Ct has in personam jurisdiction over the Florida State AG under either the Federal or Illinois long arm statute.
