To be precise, an immigration court denied him a bond in a preliminary hearing, finding that AG had not proven that he was not a danger to the public, because a confidential informant had said he was MS-13. What is your point? Immigration court doesn’t operate on a “proof beyond a reasonable doubt” standard. If an illegal alien is possibly a member of an international terrorist gang, then deport the illegal immediately!

I think it's only a civil penalty, not criminal, but he wasn't here illegally anyway. He is married to a US citizen, and the same judge who ordered him deported also granted him withholding from removal on the grounds he would face persecution in El Salvador.
Garcia was a legal US resident when he was apprehended, and the DOJ admitted to SCOTUS his removal was illegal.
That said, I don't think this will end well for Garcia, even if El Salvadore agrees to release him. Assuming he is/was a member of MS-13, he will only be in the US long enough to change his deportation status.

(2) twice the amount specified in paragraph (1) in the case of an alien who has been previously subject to a civil penalty under this subsection.
Civil penalties under this subsection are in addition to, and not in lieu of, any criminal or other civil penalties that may be imposed.
(c)Marriage fraud
Any individual who knowingly enters into a marriage for the purpose of evading any provision of the immigration laws shall be imprisoned for not more than 5 years, or fined not more than $250,000, or both.
(d)Immigration-related entrepreneurship fraud
Any individual who knowingly establishes a commercial enterprise for the purpose of evading any provision of the immigration laws shall be imprisoned for not more than 5 years, fined in accordance with Title 18, or both.

8 usc 1325 is for illegal ENTRY into the country. That's a misdemeanor, which he was guilty of in 2011 (I think that's when he got here.
Being in the country illegally is just a civil violation. He was here illegally for years, but when he was apprehended he was a legal resident.
