Dems couldn't be bothered with Laken Riley but this is the hill they want to die on. Really really weird people.

An immigration court found he was a member. And immigration appeals upheld that decision.

To be precise, an immigration court denied him a bond in a preliminary hearing, finding that AG had not proven that he was not a danger to the public, because a confidential informant had said he was MS-13. The appeals court found that the immigration court did not abuse its discretion in denying the bond. This is nothing like a criminal conviction, or even a civil trial.

What is your point? Immigration court doesn’t operate on a “proof beyond a reasonable doubt” standard. If an illegal alien is possibly a member of an international terrorist gang, then deport the illegal immediately!

Well, the most obvious one is being in the country illegally. That is literally a crime.

I think it's only a civil penalty, not criminal, but he wasn't here illegally anyway. He is married to a US citizen, and the same judge who ordered him deported also granted him withholding from removal on the grounds he would face persecution in El Salvador.

Garcia was a legal US resident when he was apprehended, and the DOJ admitted to SCOTUS his removal was illegal.

That said, I don't think this will end well for Garcia, even if El Salvadore agrees to release him. Assuming he is/was a member of MS-13, he will only be in the US long enough to change his deportation status.

It's still illegal and you are wrong anyway

(b)Improper time or place; civil penalties

(2) twice the amount specified in paragraph (1) in the case of an alien who has been previously subject to a civil penalty under this subsection.

Civil penalties under this subsection are in addition to, and not in lieu of, any criminal or other civil penalties that may be imposed.

8 usc 1325 is for illegal ENTRY into the country. That's a misdemeanor, which he was guilty of in 2011 (I think that's when he got here.

Being in the country illegally is just a civil violation. He was here illegally for years, but when he was apprehended he was a legal resident.

Let that a-hole fly to El Salvador & plant some drugs in his suitcase or plane and arrest his entire convoy and the. He can be “reunited with his fellow Marylander In CECOT FOR LIFE”

That would be the way to handle this!!!!

he's MS-13, but I think that is a point of contention with his team.

Sure, he can claim he’s not and/or left the gang. Go for it.

J6 asdholes full constitutional due process, and you know it. They were provided every opportunity for their cases to be heard. Many chose to plead guilty…

Wow!! Is there more evident grandstanding??
The man was elected to represent his voters, tax paying American citizens, amd he's wasting his time on this shite??? Maryland should try harder.

I hope more of them double down and take trips to other countries to have a press conference and talk about how they are going to bring an illegal criminal back. Keep that up and maybe 20% of the country will vote Dem. No Americans want that.

It has gotten to the point that they preach the opposite of what the administration is doing just because the administration is doing it, no matter what the topic is. Problem is they are essentially campaigning against common sense because Trump is for it. It has nothing to do with what the people want.

I hope they continue to show their arse until the next election. That will seal a landslide.

LOL you groomers support violent gang members that are raping and killing our citizens. You should sit this out but your arrogance won't allow that.

Keep rooting for these animals. They are perfect representations of your part right now.
