How can we (legally) keep illegally-obtained funds?

Who's going to enforce this, in your ridiculous hypothetical?

Tell the government that. Ever met anyone who had their stuff taken from asset forfeiture wrongly? Takes years if not decades to get it back.

I know. It’s super fricked up we allow the government civil asset forfeiture. But MAGA loves them some full throated Government trespasses.

You're ignoring the "legally" in my question.

I described reality.

The tariffs were ruled illegal, correctly.

This means the government illegally seized money.

Keeping it would also be illegal.

So you think they should be able to keep illegally obtained funds?

Yikes. Would love to see the reaction you have if the president didn't have an (R).

You thinking the executive branch should ignore rulings will be hilarious to watch when the other side is in charge.

Why didn't the buffoon and his cabinet of idiots do it right the first time?
Constantly tripping on their own dicks in overstepping the law and the constitution, while the working people of this country always pay the price.

When will y'all realize that this guy is a fricking moron who is way out of his element? He was born with money and has done nothing to help Main Street America.

Divide and destroy has been his only aim, while enriching himself and disgracing our country and what it stands for.

SCOTUS opinion merely upheld the ruling from the Federal Circuit. The Federal Circuit confirmed the court of International Trade decision that the tariffs were illegal, but removed the injunction against the tariffs and remanded the case back to the CIT to reconsider the appropriate remedy.

So, im not sure how long it will take, but this lands back in the CIT to decide what to do now that the tariffs were illegal.

It seems certain the actual plaintiffs will get yheir money back.

Hopefully, the DOJ will show up with a reasonable plan for how to treat other importers, such as means to apply for refunds or future credits. Maybe they will just declare that refunds would be un-American and fight that all the way back to SCOTUS.

OK counselor then how will the entities allegedly affected prove that they did not pass down the costs associated with the tariffs to their customers? Should THEY have recourse?

Why should those entities benefit from a refund and the bounty from passing on said costs? Were they ever harmed to begin with? To everyone screaming that tariffs cause inflation and drive up prices theres only one way this happens. The tariffs are passed on and the ones wanting refunds were never harmed.

It isn't as simple as you want it to be. As far as impeachment and removal for THIS? Try it and see what a shite storm happens.

I never said this would be simple.

That's why I said the admin should admit their mistake months ago before all of this complexity occurred.

If it comes to that, they should have to demonstrate commensurate business loses. If they simply passed costs on, they shouldn't be entitled to 1¢

This decision is going to have MAGA parroting that all costs were passed through and consumers paid the tariffs, after months of parroting that other countries and importing businesses bore the brunt

Stunning time to be alive.

That's going to be a mess.

Saw some group of 800 small businesses already sent letters to congress and the WH demanding refunds for what they paid in tariffs.

Whats going to get interesting is the consumers. You know those businesses didn't eat the tariffs, so if a consumer comes and demands refunds from the businesses, what happens?

Exactly.

The response will be: Provide documentation of all invoices/pricing for the last 3 years to prove that you did not pass along the costs to consumers/customers.

We are about to see the "deny it's happening.....admit it's happening but it's a good thing" progression meme unfold.

Looks like he did. POTUS Trump and America are in much better shape now after this decision. Simple Art of the Deal maneuver played out perfectly.

I can not wait until he starts requiring licenses, permit, license fees and permit fees for those who want to do business with America.

A big door called "Increased Foreign Revenue" just opened real wide.
