Absolutely covered by the 1st Amendment to burn your OWN American flag if you so chose. You can't however, go around tearing down other flags or burning them, that's destruction of property.

Yes, BUT specific carve outs can be made as has been done with the second amendment and red flag laws, etc.

I don't necessarily like it, but sometimes things become issues that the forefathers may have never thought would be possible. Making adjustments should be possible in such circumstances. Someone that is a harm to themselves let alone others should not have access to firearms, and freedom of speech should not extend to desecrating the flag of the country in which you live, are a citizen, are currently in, whatever it may be. Slippery slope? Maybe, but if you're in China you will die for burning their flag no matter who you are.

unfortunately free speech includes the stuff I hate, so yeah burning flag (your own property, not stolen) should not land you in jail.

I guess there is an argument that you could be inciting something by doing it in public. I doubt there are that many people burning flags in the privacy of their own back yard

Right. They could face charges similar to what they would face if they burned a cardboard box in public. Now, the hate crime angle is a possibility.

Right on brand for Thomas Massie and the other malcontents who prop him up as some sort of libertarian champion of the Constitution. It’s going to be very gratifying to see Massie go down in flames next year.

Yep. That's the whole point. No need for an amendment protecting speech that's universally popular.

If they violate other laws in the course of burning the flag charge them with violating those laws.

What about burning the Ukrainian flag? Would a that run afoul of the administration’s foreign policy and be national security issue?

PROSECUTING BURNING OF THE AMERICAN FLAG

My Administration will act to restore respect and sanctity to the American Flag and prosecute those who incite violence or otherwise violate our laws while desecrating this symbol of our country, to the fullest extent permissible under any available authority.
