Unlawful presence is overstaying a VISA which is a civil offense. Illegal Entry without ever having documentation is absolutely criminal.
A very quick google search proves this, but in typical AOC fashion, she uses selected information to get support from her base using an absence of the full truth.

The only legal question I can think in this situation is what rights and protection does a citizen have regarding their house being searched without a warrant if it's assumed they are harboring a criminal alien.

You're absolutely correct. It implies a default state of legitimacy that is later altered or somehow lost.
