It’s a bullshite attempt to get back to and stay in the US.

We need to fix the bullshite asylum claims. I stand at the border with a big DENIED stamp for all of them.

It's relevant that just being a member of MS-13 is a crime in El Salvador, which is where he is currently in prison.

You are harping on the laws of one country, while ignoring the laws of another.

Do you think your administrative processes and procedures trump the criminal laws of a foreign country, and one of their citizens?

Do you think the United States would let a citizen criminal out of prison to return to a foreign country for an administrative immigration hearing?

No, of course not.

Killing innocent people in a drone strike is a massive error and is met with less outrage and less meaningful remedy than what you propose.

Sending a dude home due to administrative error and having no equitable remedy available is a blip that normal people just score as a win.

The membership in MS-13 may not have an impact on the procedural processes it was claimed he was not afforded, but it does matter when 90% of the people got hooked on outrage in this case because he was portrayed simply as a Maryland father. It is pure propaganda by the media. Maybe a dozen people would care about this if he hadn't been portrayed in that manner.

If that illegality brought him to the jurisdiction of that foreign country? Yes

Hence why the illegality is always present until rectified.

We've negotiated releases into freedom in other countries before (and quite often). No administrative hearing was even necessary.

They happen every day, and people sue over them, and they probably usually lose

This one just happens to involve something you guys dislike - the idea of removing criminals who don't belong here and sending them home.

No. This involves something larger: a scheme by the admin to permit illegality without review.

The worry is if these schemes are permitted, they can legally expand to citizens and be abused by the DEMs.

Hmm... the illegality was sending him El Salvador, right? Not deporting him, but landing him in ES.

So... as long as he was on US land or in US airspace, nothing illegal happened yet.

But once he was in ES, he wasn't subject to US jurisdiction.
