re: Hey Democrats, if Kilmar Garcia isn’t MS-13, why does he have MS-13 tattooed on his hand?

Every rival gang member is afraid the rival gang is going to kill them.
That’s kinda how these violent gangs work.
It’s a bullshite attempt to get back to and stay in the US.
We need to fix the bullshite asylum claims. I stand at the border with a big DENIED stamp for all of them.

And? That is also not relevant to the legal discussion
It's relevant that just being a member of MS-13 is a crime in El Salvador, which is where he is currently in prison.
You are harping on the laws of one country, while ignoring the laws of another.
Do you think your administrative processes and procedures trump the criminal laws of a foreign country, and one of their citizens?
Do you think the United States would let a citizen criminal out of prison to return to a foreign country for an administrative immigration hearing?
No, of course not.

It's up to the admin to figure that out.
You missed your calling in the State department. “Uhhh. Uhhh. They have a hostage?? Just tell them to release him. Yea.. that’s it! Figure it out!!”

This "every error and misstep of the US government is conclusively rectified" thing is just bizarre
His family can attempt to sue for damages.

It’s completely absurd. 100%
Things get absurd when the Admin branch doesn’t follow US legal processes. Now we have an absurd legal situation.

And the illegality is still present and not rectified.
It is in El Salvador. Where he is from. Where he is a citizen. Where he is currently located. Where he belongs.

How is a prisoner swap involving a Russian arms dealer relevant to this discussion?

Shows the magnitude of this severe frickup
No it doesn't
Killing innocent people in a drone strike is a massive error and is met with less outrage and less meaningful remedy than what you propose.
Sending a dude home due to administrative error and having no equitable remedy available is a blip that normal people just score as a win.

It is pure propaganda by the media. Maybe a dozen people would care about this if he hadn't been portrayed in that manner.
I could be wrong but I think he was calling the opposite side the one engaging in spectacle. I'll await his response

The illegality occurred while present in our country.

While he's present in the US? Yes
If that illegality brought him to the jurisdiction of that foreign country? Yes
Hence why the illegality is always present until rectified.

We've negotiated releases into freedom in other countries before (and quite often). No administrative hearing was even necessary.

just bring him back and have the hearing
Why bring him back? Have the hearing without him physically present (zoom) just his lawyer(s) and the government lawyer(s) in the room.

They happen every day, and people sue over them, and they probably usually lose
This one just happens to involve something you guys dislike - the idea of removing criminals who don't belong here and sending them home.

It shows that even worse people without the underlying illegality involved can be negotiated for release.

MS is his darling child's initials, and 13 was the year the child was born.

Yes
Or we can just acknowledge it's moot, which it is

No. This involves something larger: a scheme by the admin to permit illegality without review.
The worry is if these schemes are permitted, they can legally expand to citizens and be abused by the DEMs.

That’s not true. What I dislike is when the govt. refuses to follow court orders.

Hmm... the illegality was sending him El Salvador, right? Not deporting him, but landing him in ES.
So... as long as he was on US land or in US airspace, nothing illegal happened yet.
But once he was in ES, he wasn't subject to US jurisdiction.
This is a case of Schrodinger's Gangbanger.
