While lawfare frequently has targeted GOP politicians, the tactic is spreading to the legal profession as a group called "The 65 Project" has taken to social media vowing to go after the licenses of attorneys who chose to work for former President Donald Trump.

The 65 Project, which launched earlier this year as a "bipartisan" watchdog with both prominent Democrats and Republicans, announced it had launched digital and print advertisements in swing states such as Wisconsin and Michigan with the stark warning, "Don't lose your law license because of Trump."

quote:

The 65 Project has a list of lawyers that it has filed ethics complaints against, including former Trump lawyer Jenna Ellis who worked on an Arizona election subversion case, Kurt Olsen who represented Arizona gubernatorial candidate Kari Lake in her 2022 election fraud case and Harvard Law School Professor Emeritus Alan Dershowitz.

Dershowitz told Just the News in a statement that what the group is doing is "pure McCarthyism."

"They already filed a complaint against me," he said. "It’s pure McCarthyism. And unethical. And it’s scaring some lawyers away."

Pretty sure any lawyer working with Trump already knows what they’re getting into.

But can you prove this is like lawfare? It’s probably just a friendly reminder that your house could burn down if you do the wrong thing.

In Louisiana, threatening to file a bar complaint is unethical (but I doubt any of the lawyers who commented are licensed here).

As always, the devil is in the details.

The actual source

quote:

“Across the country, lawyers who lent their credibility as officers of the court to Donald Trump to file factually and legally baseless claims to overturn legitimate election results have been investigated by state bar associations, been fined, had their licenses suspended, and even disbarred,” said The 65 Project Managing Director Michael Teter. “We have filed 86 bar complaints to date and are reminding lawyers that we – and the public – will be watching them.”

That's not vaguely threatening to file. It's saying if they find unethical conduct they will file, and don't get caught up (like Jenna Ellis, Rudy, etc. did after the 2020 election).

*ETA: also this article is all over the place

quote:

Last month, Trump was found guilty on 34 counts of falsifying business records in the first degree for his reimbursement of a $130,000 payment his then-lawyer Michael Cohen made to porn star Stormy Daniels ahead of the 2016 presidential election.

So much for the right to legal representation. These people hate our constitution. They hate freedom.

What’s the penalty for a random citizen making such generalized preemptive type threats?

No. "The crime" was documented.

They filed a bunch of fraudulent pleadings and could not provide the least bit of evidence or precedent to support them. That's unethical.

If a client asks me to do something unethical I immediately terminate the relationship.

If it's without any merit, a defamation/libel suit.

99.99% of a lawyers job is unethical.

So, you think that’s what this is?

That depends on the merits of the underlying complaint

If we're talking what Jenna Ellis, Rudy, etc. did, then no.

If Dersh really got one, and it was bogus, then yes.

Not at all. Lots of people need help without anything close to unethical behavior necessary.

I think 99% of their job is sending out emails trying to get me to sue someone, anyone.

Its a fricking embarrassment.
