A divided federal appeals court has maintained a temporary block on President Donald Trump’s ability to use the Alien Enemies Act to quickly deport alleged members of a Venezuelan gang.

The DC Circuit Court of Appeals panel ruled 2-1 on Wednesday that a pair of lower-court orders blocking Trump’s use of the sweeping wartime authority can stand while a legal challenge to the president’s invocation of the law plays out.

quote:

Wednesday’s appeals court ruling was unsigned. But Judges Patricia Millett, an appointee of former President Barack Obama, and Karen Henderson, an appointee of former President George H.W. Bush, wrote lengthy opinions explaining why they agreed with the court’s decision.

Henderson leaned into the argument that allowing Trump to use the law — even as the case proceeded — “risks exiling plaintiffs to a land that is not their country of origin” where they would face torture in notorious prisons.

quote:

Judge Justin Walker, who was named to the bench by Trump during his first term, dissented, focusing on a technical issue he raised during the oral arguments in the case. Walker said the claims filed by those deported needed to go to a court in Texas rather than in Washington, DC.

quote:

The Trump administration is expected to appeal the ruling to the US Supreme Court.

If Henderson is so concerned maybe he should join them.

It was pretty clear as to how they would vote.

They should be unseated.

From the text of the Alien Enemies Act

quote:

When an alien enemy is required by the President, or by order of any court, judge, or justice, to depart and to be removed, it shall be the duty of the marshal of the district in which he shall be apprehended to provide therefor and to execute such order in person, or by his deputy or other discreet person to be employed by him, by causing a removal of such alien out of the territory of the United States; and for such removal the marshal shall have the warrant of the President, or of the court, judge, or justice ordering the same, as the case may be.

This country is simply beyond repair.
The water has been heating up and is now boiling while all of the frogs sat around on their iPhones and Covid money with record consumer debts.

I know the experts say that Trump shouldn't have to ask permission. But if he can get his own district judges to sign off, wouldn't that stop this DC bullshite?

Question, by this following quote- is this an easy way to deport these people TO their Country of Origin with the court's implied blessing?
quote:

Henderson leaned into the argument that allowing Trump to use the law — even as the case proceeded — “risks exiling plaintiffs to a land that is not their country of origin” where they would face torture in notorious prisons.

Some of those countries, like Venezuela, don't want their hardened criminals back, and no other country wants them either, certainly not to loose upon their own population as was done here. The Alien Enemies Act does not specify where they should go other than "out of the territory of the United States"
