He can afford better lawyers. He'll roll on them.
They also have no plausible means of pretending they were reporters and not participants whereas he just needs to convince one juror he was there in a professional capacity in spite of the incriminating communications.

In Minn, he'll get a jury of his "peers". Enough said. Note than when EWE kept his legal violations dismissed, it was because his State jury of his peers found him not guilty. The one time he was convicted was by his Federal jury of his peers.
