FWIW, Chemerinsky seems to be the last of a dying breed — a leftist that is a free speech absolutist.

Yet this ultimately is the end result of all these Jacobin movements: they invariably will turn upon themselves as sure as the sun will rise in the morning sky.

It is not a matter of if but when.

I used to see the full burka women in the Quad at LSU. I referred to them as Jawas, because quite frankly, that’s what they looked like.

I met him once. He was a really good debater at Northwestern (not the one in La.). Extremely intelligent young guy. Later on I noticed he was a TV analyst during the OJ trial. He did a really good job at that.

To be fair, these people are old school liberals.

He is for free speech, even that which is offensive and racist.

What he isn't for are for trespassers. These people were trespassing in his back yard and they had every right to make reasonable attempts to move them.

Chemerinsky supports free speech in the public sphere — and even the quasi-public sphere such as social media platforms.

Chemerinsky was indeed critical of Big Tech’s banning of Trump and likewise voiced opposition to the recent gag order placed on Trump by a U.S. District Court:

Troubling ruling

What is particularly troubling about Chutkan’s order is that it seems primarily concerned with protecting prosecutors and court personnel from Trump’s vitriol. The law is clear that speech can’t be restricted to prevent government officials from being criticized or even vilified.

The Supreme Court has repeatedly held that the First Amendment protects a right to criticize government officials, even harshly. In New York Times Co. v. Sullivan, issued in 1964, the court unanimously declared that the amendment expresses a “profound national commitment to the principle that debate on public issues should be uninhibited, robust, and wide-open, and that it may well include vehement, caustic, and sometimes unpleasantly sharp attacks on government and public officials.”

There is no reason to believe, moreover, that Trump’s criticism of Smith, his staff or court personnel will prevent a fair trial. It is impossible to imagine that Trump’s attacks will change how the prosecutors behave. And given all that Trump has said and all that has been said about the events of Jan. 6, it is inconceivable that more speech will do much more to prejudice prospective jurors.

Trump’s got the right

Chutkan could have issued a narrower order limited to speech about witnesses but didn’t. Ultimately, the judge imposed a gag order on Trump because his speech is often unpleasant and offensive. But that is simply not a basis for restricting speech under the First Amendment. We may loathe what Trump says, but we must defend his right to say it.

My brother has had several meetings with that dude (not when he was at Cal Berkeley, at another institution).

Supposedly he's a really nice guy, but one of those props that thinks everyone is a good person.
