I hate this commie Mandami. I am just pointing out what this is factually, with no opinion on it either way, except that if a DSO kills a family member in a wreck and they do not have enough insurance, then I should be able to pursue Amazon, who controls the entire process.
None of this really matters in terms of liability. The liability still falls on the contractor, and Amazon makes damn sure of that. I mean, they can sue Amazon, but I almost guarantee that Amazon has all of their t's crossed and i's dotted to protect themselves.
What will happen is the injured person will sue Amazon (and the contractor) in tort, and then Amazon will file an impleader (or crossclaim) against its contractor under their contract.

The injured party is protected against underinsurance of the contractor.

The DSOs do the hiring, pay the wages, supply benefits, pay for office space, , find and pay the insurance, etc.

Your assertion is insane.

Commies hate small business because they cannot hide the confiscation from them.

The person actually gets to collect ALL of their own money and then has to give it to the government. Unlike withholding.

That level of control would make Amazon vicariously liable, regardless if their categorization as an "independent contractor."

Amazon clearly understands how much separation they need to shield themselves.

The operators of these delivery businesses are no different than any other franchise operator.

If you own a McDonald's, you can only sell their menu items, your team wears McDonald's uniforms, there are standards you must uphold, and performance structures are in place. They can yank your franchise from you for not meeting their terms

Zero difference between that and what Amazon does.

I sell on Amazon as a 3rd party, and even that comes with metrics Amazon expects me to meet or stay above, or else they terminate my account.

It's really silly of Motorboat to be so obtuse that he doesn't understand a franchise agreement can still demand all of these standards and still meet the threshold for a subcontractor relationship under IRS guidelines.

Exactly.

Three pages of arguing the "good" reason, Amazon does not want to be liable.

The "real" reason, the jobs go back to Teamster controlled delivery AND EVERYONE pays excessive costs to pass on to the drivers and ultimately the Teamsters.
