I think a judge should have discretion in the sex offender list if the suspect is within 5 years of the victim. My understanding is that the victim here has to be 14-17, but that the rule is 10 years.
I see no need for discretion if a 24 year old has sex with a 14 year old. And while I do not think gay people are inherently inclined to pedophilia, I do think gay culture has arguably been more enthusiastic for pretty gross young-old relationships that fall into the ranges covered by this law change, including those which cross legal lines. Basically it got lumped in with the libertine rejection of all other conservative values.
So I can see that history and attitude resulting in scenarios where a judge doesn't punish the 25 year old for hooking up with the 15 year old. Which would never happen for a M-F relationship in 2020.

Well that is how it already is. And I'm sure that's how they're framing this too.
In theory - no objection. While I don't have a problem with a 20 year old being prosecuted for having sex with a 16 year old, I'm not sure he should be on the same list as a bonafide child molester. Maybe we could make some separate "dirtbag" list for distinction purposes, but regardless, a young person having sex with a consenting teen probably isn't something that should follow them forever in a lot of scenarios.
But I don't think you need 10 years, and I don't think California judges are going to apply this fairly considering the libertine celebration of these relationships in the old school gay community.
