There are quite a lot of differences between the two. A lot of protections afforded citizens that are not available to noncitizens. A lot of rights available to citizens that are not available to noncitizens - and on and on. . .

Just wondering why one judges opinion is sacrosanct, but the law itself isn’t merely because it hasn’t been used in a long time.

Saying something isn't a fact doesn't mean it isn't. It is obviously impossible to deport all illegal aliens in 4 years if each of them gets an appeals process. You cannot dispute this fact.

Someone should have let the White House and DOGE know that before they fired 20 new judges, halted the staffing of new courts that were supposed to open, and just announced they are cutting the BIA down.
Further they tried to tell judges to pre terminate asylum cases that are “deficient” with no other guidance. Thats about to open up a whole other set of lawsuits.
They are really starting to step on their own dicks here.

Why do people say so factually incorrect stuff so confidently. Withholding of Removal is literally statutory meaning it was created by Congress. A judge doesn’t just get to just decide where a person can or can’t be deported, they have to follow statute.

1) Staff until the backlog is addressed; 2) Violate the INA and the SCOTUS case law granting various levels due process to non-citizens and deport everyone with no hearing; or
3) Rewrite the INA.
2/3 are feasible.

Immigration judges and BIA judges are all administrative law judges. Trump can hire them as he pleases without needing advice and consent of Congress. If he were to hire lefties activist judges that’s on him.

Which is what makes this entire "fight" stupid. This is surface level "due process" at best. The people crying about due process are clearly just advocating for the illegals.
