Offices of Nike Legal Team:

"So this idiot called us to do some extortion."

*picks up phone*

*dials the FBI*

"Hey you guys want to listen to the next phone call where this a-hole Avenatti tries to blackmail us?"

"Yup, sounds like fun."

Hard to believe Avenatti, supposedly a lawyer, is so bad at doing crimes.

It appears they waited and he tweeted to provide damning information against himself.

What a fricking idiot. Did he really think Nike and their lawyers would just lay down??

well he has arguments/defenses on this one

the one out of California? if those allegations are close to true he's fricked

you can make a civil demand on a party and make certain threats along with that. apparently these allegations involve criminal activity, which is where you can get into trouble

threatening the market cap may also be seen as extortion

Here is an article on the issues

quote:

Those two factors create a combustible mix in the demand letter. Thousands of demand letters are sent every day and they are, by and large, boring: here’s why I think I’ll win the case, here’s what my client’s damages are, and here’s how much I’m asking you to pay. They only get exciting when: (1) the damages exceed the available insurance policy limits, and the plaintiff’s lawyer is trying to set up the insurance company for claim of bad faith; (2) when the lawyer threatens to cause harm by way of the legal system itself (e.g., the infamous “legal equivalent of a proctology exam” letter, which was reversed on appeal); or, (3) when the plaintiff attempts to threaten the defendant with some consequence beyond the mere pursuit of the lawsuit, like exposing them to embarrassment or criminal prosecution.

he's likely fricked

*ETA: CPL using generic threats and not threats tied to litigation likely will be what get him

quote:

In Flatley, the California Supreme Court held that a letter demanding “seven figures” sent to Michael Flatley (yes, that Michael Flatley) by a lawyer representing an alleged rape victim was, indeed, extortion, because, “At the core of Mauro’s letter are threats to publicly accuse Flatley of rape and to report and publicly accuse him of other unspecified violations of various laws unless he ‘settled’ by paying a sum of money to Robertson,” plus assertions that, in the course of the litigation, information about Flatley’s wealth, tax, and immigration status would be found and filed with the Court.

Was the letter in the Flatley case more aggressive, hostile, and belligerent than Singer’s letter? Certainly. Could it have lead to a state bar disciplinary investigation against the lawyer? I’d sure hope so. But those threats were just as “inextricably tied” to his client’s claims as the threats in Singer’s letter were, and in the end the essential threat was the same: settle with me, or we’ll file a public lawsuit that will include the publication of private facts that will embarrass you.

I mean if they're asking you over the phone to tell them what you wanted to do again and basically repeat the entire conversation again, it's probably a good idea to hang up and never call them back or even have a press conference.

It's like a moron super villain telling the good guys their evil plans with explicit detail.

By the way, I'm seeing now one of the charges he was indicted on is a 20 year count. He's in deep shite.

I'm no lawyer but here's how I know it's very bad for CPL.

Bottom line is, the stuff CPL "has" on Nike still exists. Yet, Nike and it's lawyers deemed it better and more likely to succeed if they turned his as in and busted him.

I'm no lawyer but some very smart ones WILLINGLY placed their company in PR jeopardy to nail CPL.

That can't be good

Cost benefit analysis showed that they could afford the losses, Avenatti can't as he's a broke dick ambulance chaser that's desperate for money to pay for all his lawsuits, child support and so on.

Meanwhile, federal prosecutors in New York say Avenatti attempted to extort $20 million out of Nike by threatening to release damaging information about the company if it did not meet his demands.

“I’ll go take ten billion dollars off your client’s market cap,” Avenatti told attorneys for Nike on March 19, according to a complaint filed by the Southern District of New York. “I’m not fricking around.”
