No doubt. That kid was trying to put his own head through a glass door so I pulled him away from it for his own safety. That's when he swung on me. Funny how the board said he was so out of control due to his exceptionality on his IEP yet when I told him if he kept swinging I'd swing back, he calmed down quick, fast and in a hurry.

I was told after the fact that if I had hit him back and defended myself, I would not have been in legal trouble but I likely would've had civil responsibility and certainly would've lost my job. Let me say that again, if I would've defended myself against a 250 lb. 18 year old who was assaulting me, I would've been fired and maybe even HAD TO PAY HIM.

AT minimum I would've been unemployed and had to pay legal fees to defend myself. I quit teaching that year and never looked back.

Wouldn't the school be liable for not intervening?
