Baraboo School District weighing legal action students photographed doing Nazi salute

The controversial image was taken in the spring, the Baraboo School District said, and it began circulating on the Internet on Monday after it was posted on a Twitter account that's since gone private.
“The photo of students posted to #BarabooProud is not reflective of the educational values and beliefs of the School District of Baraboo,” Superintendent Lori Mueller said. “The District will pursue any and all available and appropriate actions, including legal, to address.
Here is the kicker... It didn't happen at a school function or on school grounds. YET THE POLICE ARE INVESTIGATING THESE KIDS!

Nothing. If these guys hire a decent civil rights attorney, the school district will get eaten alive in court. It's their 1st amendment right to do whatever it is they're doing in that photo.
If it happened at school, then they could discipline them because schools have some power to enforce rules that wouldn't fly "out in public" (such as dress codes and the like). But according to the school it didn't happen at school or a school function. Therefore, the school has no legal ground to stand on (and I think they know it).
These guys are fricked, though. Goodbye college admissions and most future employers.

They could argue all sorts of things, claim they threatened the black students on campus, that they are endorsing a hate group, intimidation by hate speech...
