Transwomen, of course, are biological males who believe they are female. The commissioner admits that biological males can't get pregnant. But "transwomen" (i.e. males) have the "potential" to get pregnant and therefore deserve workplace consideration.

I think she is essentially saying that someone who presents as female (whether biologically male or not) must be assumed to have the capability to become pregnant and as such should be extended the same protections.
