Same hat, face and having been there and done that (military) I can tell you 100% what he is doing, pointing the rifle to fire as he said he was poised and there to do. There is CLEAR audio evidence of the AK-47 firing off 5 shots followed by 3 shots of a different pitch.
Rifles have far different reports than handguns. Dumbass shot first and missed. Guy in car shot in self defense and ended the threat to his life.

The stock is almost in the same position.
There is a triangle shape clearly in front of his shoulder which pokes up in front of the guy's face behind him. It's also hollow as you can see a sliver of the guy's neck in it. It is also the identical shape as the AK stock being held in his interview.
Given the testimony that he approached the vehicle with it in ready position and both photos, you'd have to be attempting not to see it to suggest this is anything BUT this guy doing precisely what was said he did.
