This is so confusing to me. The people protesting his deportation are carrying signs saying "bring him home". Isn't that what the Trump administration already did?

Steven Miller made a strong argument for the Alien Enemies Act removing the impediment to deportation to El Salvador: the protective order entered by a Trump immigration judge in 2019.

Are all DOJ lawyers hold-over sabatouers? Why hasn't the DOJ amended their pleadings to assert that Abrego Garcia was deported under the AEA?

Those supporting the Executive's action are working from the premise that the ends justify the means, that what the Supreme say what the law is as a part of judicial review is subordinate if not irrelevant to the whims of the executive.

No, dummy, if you are not going to respect the concept of judicial review, something that has been a part of our government since John Marshall, 225 years ago, then there is no rule of law nor respect for the Courts. Just the repercussions of an executive who twists with the wind of populist sentiment.

Exactly right. Of course, Abrego Garcia will and should be permanently removed from the U.S. Which I applaud.

I'm not too keen on establishing the precedent of "if the Executive removes ANYONE beyond the jurisdiction of American courts, there is nothing that can be done by the Judiciary to challenge that removal." With the mood of the country and the urgent need to get rid of Biden's illegals, I think that's where we're headed. Buckle up.

Here's what the panel (including very conservative Judge Wilkinson) wrote:


"And the differences do not end there. The Executive is inherently focused upon ends; the Judiciary much more so upon means. Ends are bestowed on the Executive by electoral outcomes. Means are entrusted to all of government, but most especially to the Judiciary by the Constitution itself.

The Executive possesses enormous powers to prosecute and to deport, but with powers come restraints. If today the Executive claims the right to deport without due process and in disregard of court orders, what assurance will there be tomorrow that it will not deport American citizens and then disclaim responsibility to bring them home?

And what assurance shall there be that the Executive will not train its broad discretionary powers upon its political enemies? The threat, even if not the actuality, would always be present, and the Executive’s obligation to “take Care that the Laws be faithfully executed” would lose its meaning. U.S. CONST. art. II, § 3; see also id. art. II, § 1, cl. 8."
