Doesn't matter if congress creates something. The executive doesn't have to do it. Congress' power is the money. They can deny money for things or put money up for things but the president doesn't have to spend it, that is the next fight to win.

The remedy for a president not doing something is the voters electing someone else if they dont like it.

I believe the supreme court will overturn Humphrey's Executor soon as well.

To be honest, I dont even know why we need these agencies in the first place.

Congress passed a law establishing the NLRB and continues to fund it. That law stated the President will appoint the members of the board subject to advise & consent of the Senate. Congress granted him that power in the Wagner act. If the President has the right to appoint, he has the power to remove.

If Congress wants that power back, they can amend or repeal the Wagner act.

That law also established the 'independent' part which means those appointments make the decisions without direct control from any other member of EITHER the legislative or executive branch, including the President. So limited powers were granted to the executive branch by Congress creating the independent part (subject to oversight by Congress and since they have police powers review by the DOJ).

One of those powers not limited, in fact specifically granted, was appointment.
