I can understand a civilian speaking in that manner and nothing is said. However, if 1,000 veterans like Kelly who despise the CIC suddenly start voicing the vey same tune while traveling around the country and protesting outside military bases, should they not be worried about a military tribunal or dock in pay as well?

Personally, I believe Kelly and his wife are both horrible human beings.

If a military veteran is a member of Congress and makes a speech against some foreign military action ordered by POTUS, can the SecDef court martial him for eroding good order?

I would assume if it’s under their official capacity, they are protected by the speech and debate clause.

But that’s not what happened here

That’s a fair distinction. But let’s run it out to its logical conclusion.

Does that congressperson lose a First Amendment right to speak out on an issue of national importance the moment they leave the Capitol? Can they express their views back home in their district to their constituents?

I think there is a difference in discussing or criticizing policy differences vs encouraging military members to disobey orders or command. Especially if it’s coming from an officer because they are held to a different standard within the military. That being said, I was enlisted soldier and not an officer so I’m not totally sure to be honest

At the end of the day, this is for a military judge to rule on if he violated a military oath and not a civilian judge

I'm SO sick of these damn judges inserting themselves into situations where they have ZERO legal authority. It's out of control and they need to be handled.

Why would he be concerned that former military personnel would just send a reminder to troops about their responsibilities to obey the law? This should have been a non issue but by acting out in such an extreme manner it raises suspicion that that this regime intends to do nefarious things that could land all involved in hot water.

Though some on here are too dense to understand the implications, hedgehog makes himself looks like the idiot we would expect under this current regime. If this leads to these veterans being disciplined for following the constitution then this sends a message to all Americans to sit down and shut up or you’re next.

Hopefully someday you and your ilk will find out first hand how this works so you can understand what’s coming with this regime criminality.
