Federal courts can weigh in on these issues. What burns me up on this is that the DOJ and the courts will fight tooth and nail to preserve military punishment like stripping security clearances or administrative discharges, when it comes to junior personnel. The military can violate your rights, it can completely deny you a fair and impartial hearing (a constitutional right) and these judges will gladly sign off on that. But when it's a senator that's a retired military officer, in the Democratic Party, all of a sudden they want to discuss civil rights.

If you find it share it. Im genuinely curious because in general Federal judges (except in limited circumstances the Supreme court) have no jurisdiction over military court martials...so this must not be that kind of case if true

They generally don't have the authority except in certain circumstances. Kelly's lawyer is claiming a violation of his First Amendment rights by the DoW and that charge of constitutionality is one of those certain circumstances. Kelly not being active duty only strengthens that.

The story is real.

But let's face it, what he and the others were doing was to urge members of the active military to disobey OMB, otherwise there's no reason to put out that video at all (why didn't they put it out under Biden's administration, for example). I consider it seditious but it's one of those things that's very likely to be viewed by the courts of stopping just shy of being illegal.

I would be quite content if I never saw another news story with the word judge or lawyer in it. Do you have to get a court appointed order to take a crap in Washington? No wonder nothing is accomplished.

Irrelevant, civilian judge has no authority here. This fall under UMCJ. If this dude wants his day in court in this matter that is where it must be heard.
