A transcript of radio intercepts, publicly released through Wikileaks, indicated that Bergdahl, then 23, was captured while sitting in a makeshift latrine.
'We were attacking the post he was sitting,' according to a radio intercept of a conversation among insurgents.
'He had no gun with him. ... They have all [the] Americans, ANA [Afghan National Army], helicopters, the planes are looking for him. Can you guys make a video of him and announce it all over Afghanistan that we have one of the Americans?'


A senior Defense Department official said previously said that if Bergdahl was released, it could be determined that he had more than paid for leaving his unit '.
Still, it's a conundrum for commanders under the Uniform Code of Military Justice and the equal application of the law, according to the official, who spoke on condition of anonymity because he was not authorized to publicly discuss the Bergdahl case.
Eugene R. Fidell, who teaches military justice at Yale Law School, said if there is evidence that Bergdahl left his unit without permission, he could be charged with being absent without leave (AWOL) or desertion.
Desertion during a time of war can carry the death penalty.
But Congress never passed a declaration of war with respect to Afghanistan, and neither President George W. Bush nor President Obama has determined that U.S. military operations in Afghanistan make this a 'time of war' for the purposes of the Uniform Code of Military Justice, Fidell said.
Were Bergdahl to be charged with desertion, the maximum penalty he would face is five years in prison and a dishonorable discharge, if it's proved that he deserted with the intent to avoid hazardous duty or to shirk important service

You do know that this service member deserted his post while at war to join the Taliban. Many people died trying to find him. His father... well I don't know what to make of him. When you ask the people that served with him what they think, it's not pretty. So yeah a lot people are questioning why we would give up the mother load of Taliban commanders for this seemingly POS.

Roughly twelve soldiers - including six from his own unit - died trying to find this POS after he walked off his post.

You ought to check around and read a little about what the soldiers of 1/501 are saying right now. They are mutinous. I had the good fortune of serving with a handful of Geronimos when they came to my unit after that Afghan deployment. To a man they loathed Bergdahl with a hate that cannot be described. They - and I - never thought that he would actually make it through alive.

He should have rotted in captivity for the rest of his life. Now he should rot in Leavenworth for the rest of his life. He has to answer for at least twelve deaths.

Oh you poor silly shill. If that was all there was to it, everyone would be happy about it, as I was when first reading about it. But when the thinking and honest read just a few more paragraphs of the details, on Bowe and on the Taliban prisoners released, it's very clear that this is yet another move by Obama that reeks of either ineptness ("oops, we should have done a bit more background on this deal!") or corruption ("MUST fabricate a distraction!"). Or worse.

I don't think a Pvt with a year's experience as 11B or whatever he was would be able to teach the Taliban anything they don't already know.

I know they aren't spectacularly trained or anything, but Bergdahl wasn't going to bring much to the table. Seems like a lot of trouble for zero payoff.

Personally, I'm withholding judgment until more info comes out about his capture. A lot of the "he defected" stuff sounds like the product of the rumor mill that got churning after soldiers were killed during the search to find him. People were understandably upset and it wouldn't shock me if they jumped to conclusions.

With that said, it is pretty strange that he just vanished from a post and got himself captured. He was either doing something really, really stupid, or he was deserting. Can't really defend him like he's blameless.
