Just some FYI. A Game Wardens reach is second only to a judge. He can walk in your home, place of business, vehicle, anything he chooses at anytime day or night to check for game violations. He needs no warrant at anytime. So those arguments are out the window.

To the OP...it all depends on how much headache you want. Could you hire an attorney and beat this or get a slap on the wrist? Absolutely. But it will cost you.

He still needs probable cause and in most instances he needs a warrant to search your house, place of business or vehicle. He can't just show up with no cause and search those places.

this pretty much resolves that.. and has stood up in court - many times...

Warden can't just show up at your house and start searching through your stuff without either a warrant or your consent. But OP said he was on a WMA. Entering a WMA, you're consenting to possible search while you're on WMA property.

Seems steep. Ultimately, all they really care about is your money, so there's a chance you could find a sympathetic judge/court that would knock off the community service and probation and just leave the fines. Of course, you'd probably have to then pay a lawyer, court costs, etc. so even if that happens you could end up paying more.

So my dad, my uncle and I hunt together pretty much every weekend. They are neighbors so they usually ride to the farm together and I meet them in my truck. We usually do pretty well and end up somewhere between 12 and 18 ducks. When leaving the farm they will keep their 12 and I will take any additional birds, then we will meet up in town and I will give them the rest of the ducks and go about our merry way.

Instead of having to meet up again after hunting, could I just tag the birds I would normally bring out and let them take all of the ducks we killed that day? They would still be below their possession limit and would save us an additional stop every hunt.

Actually not bullshite. Gamewardens don't need a warrant if they have probable cause to make a search. And all cops secretly wish they could be green jeans since they typically go to the same academy as State Troopers and all cops wish they were State Troopers.

If y'all read this law about tagging, it also applies to ALL game and fish. Been this way for as long as I know and I'm 60.

OP, I would go to court or try to talk to your DA and plea your case of not knowing the law. It might help.
