Its perfectly legal for her to buy the gun for you as a "gift".

The only problem would be if you couldnt legally purchase the gun on your own.

This is the correct answer

AUTimbo and others who said the same thing are correct. OTOH, I wouldn't suggest she tell the seller that it's for her husband. You'd be surprised how many sellers wrongly think what she's doing constitutes a "straw purchase."

If anyone's interested, here's the actul 4473 form she'll be filling out. Most people misinterpret question #11a and get hung up on it without seeing the explanation of the question #11a on the back page. LINK

Woah that's cool! So you could say you're getting it as a present for someone and if they call you out you can point to that question? I've never actually gone through and read the information about each question.

She is fine. Just fill out the paper work as the buyer. They don't need to know that it is a gift. Hell 3/4 of my gun collection were gifts. My grandfather liked to buy us guns for christmas. Wasn't nothing for him to go out and buy five shotguns to give for Christmas.

Potentially... Then again, I'm not thorough in "lawyer" so I wonder how much weight it would carry. Then again, I guess getting the information out there isn't all that bad of an idea.

Here's the problem. You have already admitted that you are sending her to buy a gun for you, so this is not a "gift". You have identified it in writing as a straw purchase. So, why don't you just forget this whole situation.

Personally, I have walked into a store an bought two identical guns, one of which I immediately loaned to my dad for Father's Day, and not had a problem. Of course, I didn't say "Hey, I am giving this to my dad!"

If your wife wanted to be a good wife, she would KNOW what type of gun you would want and if she was a great wife, she would give it to you as a "just because" present. And if your wife can't memorize a make, gauge and camo pattern of a shotgun, how is she on a business trip?

She did fine. They were all set to go and the guy told her that they were out of the camo one I wanted. She left. Turns out he was new and they had several in the back. I told them to hold one for me.
