Do I have use of the air above my home to the exclusion of the public then?

I've tried not to call people names in here, but got dammit if this hasn't been a hard week made harder by stupid people. I've had enough!

But don't you see you are asking to gain public access to that resource on private property
nope, no one is on or even touching your "property" they are on public water after public resources in that public water.
it has nothing at all to do with your "land", only your right to deny the public access to public waters

The good thing for y'all is most of those tards vote Republican despite crying about the rich and powerful and advocating for governments to take rights away from people, so you got that going for you. That is unless the OB is a big John Bel fan.

bullshite. OK. you're from Houma right? Drive down the bayou to Dulac and look at the businesses and homes on the way. Look at the way people keep up their own property. 75% of them are the trashiest people on the planet. Now do you think those people who don't take care of their OWN private property are gonna take care of someone else's? Do you think they are gonna care whether they tear up the bottoms or waterfowl feed or whether they are trespassing?
THEY'RE NOT. It becomes a free for all wild west bayou trash fest. The public is gonna tear it all up.

Dammit, access to the waters become private when they are over private water bottoms. Water is fluid-- it will eventually come back over public water bottoms and you can fish it then and tear up historically navigable water bottoms then.

I think landowners should send the state a bill for storing all this water for them.

From the guide vs the sheriff law suit ... "unless a navigational servitude is imposed on a waterway, the public has no right to use it." go figure

Cancel your Farm Bureau insurance polices and change them to another company if you support access to fishing for your kids and grand kids.

I would argue that Article 450 never intended the term "running water" to apply to a man made canal constructed on private property with private funds that just happens to be subject to the ebb and flow of the tide.
All of this private, man made canals are directly and substantionably contributing to land loss and erosion. Do these land owners pay more in taxes or on there own to mitigate this problem... no they do not.
Give the water back to the sportsman!

Time to sign up for Farm Bureau

Same guy pushing this bill. Seems to me he wants another crack but this time on the State's tab. Let the State pay to challenge this again because all us fishermen have lost. Doesn't matter the State lost too.

To me the best solution possible has been suggested here already. The Louisiana State Law Institute is run out of LSU and designed specifically to form Study Groups to determine if there is a need for potential legislation. Or-if they say there is a need-their committees can produce model legislation.
These study groups and committees are typically comprised of subject matter experts in a neutral fashion and allow public input at public meetings. Anyone is allowed to contribute. This is the single best approach that anyone on either side could possibly ask for. The results would address the issue as thoroughly as possible.
There’s so much uninformed yet solidified opinion here that with so many minds made up, the compromise and path forward is being ignored. It’s one that-at least for now-wouldn’t actually make a call one way or another on this.

YEAH! Tidal waters belong to the public. Submerged land may be private, but tidal waters on top are not.
Next they'll want to ban aircraft from flying over their submerged land.
