they voted on whether they would vote on it today.
i'm 100% positive that it will pass and Trump will sign it tomorrow with the $0 tax on suppressors and short barreled firearms.
expect GOA and NAGR to file a lawsuit once the bill is enacted.
it's basically what Trump did to the Obamacare mandate penalty in his first term. he made the penalty $0. well, what's the point of the penalty if it's $0? remove the penalty all together.
the NFA registry is proof that the tax was paid. what's the point of the registration if the tax is $0? remove the registration requirements.

Apparently the only reason the NFA was even deemed constitutional to begin with in the 1930s was because the SCOTUS ruled 8-1 that it was a tax, and therefore constitutional instead of a direct violation of the 2A, which it was.
But now, an unelected staffer who could have been fired/ignored, said it was NOT a tax, which directly contradicted the SCOTUS ruling.
Add to that, the Senate then took the weasle way out and just eliminated the tax fee, and here we are.
We have a law that was only legal because it was ruled a tax, and now the tax amount is zero, therefore it's no longer a tax, and thus the law is unconstitutional.
This is a total and complete fuk up shite show that will cost the Republicans in the mid terms, and will cost the GOA millions in a multi-year lawsuit. And it all could have been avoided if the Republicans weren't feckless, spineless felines.

The whole thing is a mess. Ultimately there is almost zero doubt that the NFA is unconstitutional on 2A grounds based on the Bruen ruling. The problem is that SCOTUS won't grant cert to any of these challenges (or other hardware challenges like state level "assault weapons" bans).
While SCOTUS ruled the NFA was a valid exercise of Congressional taxing authority when challenged on that ground, it didn't attempt to infer Congressional intent beyond that (which clearly was primarily regulatory).
I actually think the parliamentarian's decision was correct in the context of the Byrd Rule, because the NFA is NOT primarily a tax, it's primarily a regulatory scheme. That's why gun owners are up in arms about the tax being reduced to $0 while the registry requirements remain.
That's what is so frustrating. Democrats now openly admit the NFA is about regulatory power, which should mean a slam dunk win in the context of a 2A challenge on the Bruen standard. They're clearly nervous about these types of challenges, too, which is why Senator Murphy submitted an amendment to modify the tax to $1 rather than $0.
Congress, gun rights orgs, and gun owners have gotten the ball to the edge of the cup. All SCOTUS has to do is tap it in, but they seem to be avoiding 2A cases like the plague since Bruen.

Take the victory, there is a path forward, which bypasses Congress, to remove it. This path protects republican held purple districts.
Should they have removed it, yes. However, this also sets the precedent when the democrats do eventually take all three again, they won’t be able to raise the $200 or $0 to $10,000 without supermajorities because the GOA’s lawsuit will have already had the suppressors and shorts removed.

Yep all those frickers had to do was take silencers out of the NFA. So simple, even a congressman could do it. Or so we thought.
