If that's the case, it's only a problem if OP is up against a very tight labor and OT budget. Some business run razor thin margins.

Shouldn't really be an issue at all if the employee is actually working and not going into OT.

If you fire the whistleblower, you do it with the foreknowledge that you WILL be sued, and you WILL lose. I think that one's a given.

As far as the others go, if you're ever going to fire someone in a protected class (a woman, a racial/ethnic minority, or a person over 50), always document everything.

Thank god I'm on the sales side of the house. Nitpicking over 5 minutes sounds awful.

Having another employee punch the clock for you 5 minutes before you arrive should be a fireable offense.

Clocking in early and getting overtime (i.e. they have to stay at their station until a certain time) should get warnings.

There's definitely other issues, not just OT IMO.

A team that used to report to me basically worked 7a-730p(30 minute lunch) and 7p-730a. Well the day shift person would come in at 0630 so they could leave right at 7p when the night shift person arrived. But nothing is really going on at 0630, where as the 7p-730p slot is busier, so it's more important to have that person stay later and clock in on time as opposed to clocking in 30 minutes earlier when nothing is really going on just so they could leave early.

There's more factors than just OT.

clocking in 5 minutes early doesn't necessarily mean they are paid for those 5 minutes...our shop clocks in and some clock in 30-45 min before their shift but don't get paid until their shift begins

Our bosses are telling us to "be mindful" of the overtime. They don't seem to notice the employee who comes in an hour late, leaves 30 minutes early, takes long lunches and 10 smoke breaks a day. But, I guess she's not getting any OT, so there's that.

That could be a problem if they are working during that time and are non-exempt.

They aren't...they come in and just sit and eat breakfast while reading the paper. It's a fab shop so grinding while others aren't working and wearing protection would not be tolerated. some people love to get to work 30-45 min early

Our app rounds to the nearest 15 minutes anyway. As long as its 5 minutes early and not 8 minutes, knock yourself out.

A) If it bothered me I would talk to him
B) I would not mind if he was working
C) If our employees clock in more than 5 minutes the system automatically rolls it up.
