Woman suing the Boston Red Sox for $9.5 million after being hit with foul ball

OT Court is in session. Does she have a legitimate case?

I think it surprises me to this day that anyone can say with a straight face that being hit with a foul ball is worth $9.5 million. I'm not saying she doesn't have a case if they took protection down during construction but where does a number like that even come from?

During the year that the Red Sox finally broke the curse, Sports Illustrated had a short article about a guy that got hit by a foul ball at a Red Sox game (I think to the point of having to get medical attention). On that particular day, the Red Sox came back from several runs to win late while the Yankees lost.
The reason for SI's article is that the guy that got hit by the foul ball was living in the house that Babe Ruth lived in when he got traded to the Yankees. SI jokingly said that it may have been what was needed to break the curse. If anyone can find that article, I would appreciate it as I've mentioned it a few times over the years but always wondering if I had all of the details correct.

This probably includes claim for punitive damages. The idea is to make the bad actor pay enough to change their behavior and to deter others from engaging in the same conduct. Red Sox organization is worth billions so the number has to be high enough to get their attention.

Yeah she has a legitimate case. It was a pretty big story around here when it happened.
They've since expanded the netting behind home plate to go down the first and third base lines much further than they used to.

Normally there would be no case, but the removed glass not being replaced makes it possible that it was the park's fault.
She is suing in a tort friendly liberal state, so she has that going for her.
Red Sox are currently in first place and have the best record in baseball. Timing isn't good to get jurors pissed off about the team's performance.
I say she gets out with medical expenses covered and maybe $100k. No way she becomes a decamillionaire over this.
