Her attorney(s) can argue that the park deemed it necessary to protect that area previously for good reason and planned on protecting it again for good reason, but had failed to so during renovations and still allowed patrons up there.
Look, I hate our overly litigious society, I'm just saying in our current climate, she's going to get a settlement because her case is strong enough to go to court and the Red Sox will just want it to go away.

Now remember, some of these courts, the ambulance chasers are big donors to the judges. Ask Madison county illanoy, people from around the country filed suits there. Judges were very friendly in these cases, and by law, the ambulance chasers were allowed to donate to judges re election fund

Was she aware the glass was removed? When you go to a baseball game, you have to pay attention. I remember one time at a LSU game, I was sitting on the side down the third base line and I was almost parallel with 3rd base. There were a group of girls (they looked to be sorority sisters.. 5 or 6 of them) and I just knew one of them was going to get popped with a foul ball.
They were hitting quit a few foul balls down the third base line and these girls were not paying attention at all, to the game. I think most people sort of look as soon as they hear the ping of the ball off the bat, but the only time those girls paid attention was the one or two times the ball bit into the bleachers kind of close to them.. And they all screamed.
Of course, at a MLB game there is a different sound off the bat when the ball is hit, but you still have to pay attention.
In this case, I think whether or not she was aware of the glass being removed will play a factor. Maybe not.. IDK.. But it seems to me that when you go to a sporting event, you have to be aware of where you are sitting and pay attention to what's going on.
