like I said, maybe smith was still moving. its a non factor to me.

Cacioppo now describes hand checking as how guys in high school would kind of shove hands and arms before fight either starts or doesn't.

Not smart to empty the weapon unless he had another magazine at the ready. Armed conflict with multiple targets and an empty weapon is foolish at best. Did Mr. Hayes think no one from the MB group would respond in kind with return gunfire? He says "WS going to get gun in car", so he knows its possible. And did Mr. O'Neal at anytime retrieve his weapon from the front seat of the Hummer during this lull in the gunfire?

yeah, that one comment i made very early on when not much info was out there but regardless lsurpide and other were also being extremely presumptuous about other aspects of the case. that's all they got to clutch onto.
